GuestCam.in ("GuestCam", "we", "us") is operated by SILYA PRIVATE LIMITED, a company incorporated under the Companies Act, 2013 (CIN: U62099PN2026PTC254644), with its registered address at C/O Mr. Aannasaheb Madan Kale, AT Po – Telangashi, Jamkhed, Ahmednagar – 413204, Maharashtra, India ("Company").
By creating an event, scanning a GuestCam QR code, uploading a photo, or otherwise using guestcam.in (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.
GuestCam lets an event organiser ("Event Owner") create a private online photo album for an event and share a QR code / link with attendees ("Guests"). Guests can upload photos to that album without creating an account. The Event Owner can view, download, and manage the resulting gallery.
You must be at least 18 years old to create an Event Owner account or to purchase a paid plan. Guests uploading photos via a shared event link represent that they are legally capable of agreeing to these Terms, or are doing so with the supervision of a parent/guardian who accepts these Terms on their behalf.
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
Ownership. You retain ownership of the photos and any other content you upload ("User Content"). You are solely responsible for it.
License you grant us. By uploading User Content, you grant the Company and the relevant Event Owner a worldwide, non-exclusive, royalty-free, transferable license to host, store, reproduce, display, and allow downloading of that content, solely for the purpose of operating the event album, for as long as the applicable plan's hosted-access period lasts (see Section 8).
Your promises. By uploading any photo or video, you represent and warrant that: (a) you own the content or have the right to upload and share it; and (b) where the content depicts other identifiable individuals, you have their consent (or, for a minor, their parent/guardian's consent) to capture and share their likeness on a private event album. GuestCam does not verify these consents and relies entirely on your representation.
Events involving minors. Where an event (e.g. a children's birthday party) is likely to include photos of minors, the Event Owner is responsible for ensuring appropriate parental/guardian consent has been obtained for those minors to be photographed and included in the album. GuestCam is not a party to, and accepts no responsibility for, that consent process.

This list is illustrative and reflects the categories of "unlawful information" described in Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules").
GuestCam acts as an "intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000, in respect of User Content uploaded by Guests and Event Owners. We do not select, review, or endorse User Content before it is published to an event album, and we claim the safe-harbour protection available under Section 79 of the IT Act, subject to compliance with the due diligence requirements of the IT Rules.
We will remove or disable access to specific User Content: (a) within 24 hours of receiving a complaint about content depicting the complainant in full or partial nudity, in a sexual act, or in an impersonating/morphed image, as required by Rule 3(2)(b) of the IT Rules; (b) within 36 hours of receiving an order from a court or an appropriate government agency; and (c) in all other cases, following the grievance process in Section 15.
GuestCam offers Free, Standard, and Premium plans, each priced and scoped (photo limits, hosted-access duration, and features) as displayed on our pricing page at the time of purchase. Prices are in Indian Rupees and inclusive of applicable taxes unless stated otherwise. Once payment integration is enabled, payments will be processed through a third-party payment gateway; we do not store your card or bank details.
A paid plan is eligible for a full refund only if both of the following are true at the time you request it: (a) the request is made within 24 hours of purchase, and (b) no photos have been uploaded to the event yet.
Outside of that window, purchases are non-refundable, except where the Event Owner can demonstrate that the Service was unusable due to a verified technical failure on GuestCam's side (for example, the event page or QR code failed to load or function as intended) — in which case a full or partial refund will be issued at our discretion after we've confirmed the fault.

Photos and event data are hosted for the period stated in the applicable plan (currently: 3 days for Free, 3 months for Standard, 6 months for Premium), measured from the event's creation date. After that period, we may delete the event's photos and associated data without further notice. Event Owners are responsible for downloading their album before the hosted-access period ends.
The GuestCam name, logo, website, and underlying software are the property of the Company and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our branding except as necessary to use the Service as intended.
You must not: attempt to gain unauthorised access to any part of the Service or another user's event; upload malware or disruptive code; scrape, resell, or systematically extract data from the Service; use the Service to harass or surveil any individual; or use the Service for any unlawful purpose.
We may suspend or terminate access to the Service, an event, or specific User Content, with or without notice, if we reasonably believe these Terms, applicable law, or the rights of a third party have been violated. Event Owners may delete their own events and accounts at any time from the dashboard.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that all uploaded content will be preserved without loss.
To the maximum extent permitted by Indian law, the Company's total liability arising out of or relating to the Service, whether in contract, tort, or otherwise, shall not exceed the amount you paid for the relevant event's plan in the twelve months preceding the claim. The Company shall not be liable for any indirect, incidental, special, or consequential damages, including loss of photos, loss of goodwill, or emotional distress arising from third-party content.
You agree to indemnify and hold harmless the Company, its officers, directors, and employees from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your User Content; (b) your breach of these Terms; or (c) your violation of any right of a third party, including privacy or intellectual property rights, in connection with content you upload.
In accordance with the Information Technology Act, 2000, the IT Rules, and the Digital Personal Data Protection Act, 2023, complaints or grievances relating to the Service or your personal data may be addressed to our Grievance Officer:

We will acknowledge your grievance within 48 hours and resolve it within 30 days of receipt, except for the expedited categories described in Section 6, which follow the shorter statutory timelines.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including internet or hosting-provider outages, natural disasters, or governmental action.
These Terms are governed by the laws of India. Subject to Section 19, the courts at Ahmednagar, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
Before initiating any court proceeding, you agree to first raise the dispute with our Grievance Officer and allow 30 days for resolution. If unresolved, either party may refer the dispute to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual consent, seated in Ahmednagar, Maharashtra, with proceedings conducted in English.
We may update these Terms from time to time. Material changes will be notified by updating the "Last updated" date above, or, where feasible, by email to Event Owners. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service.
